This depends on the circumstances. In cases involving estranged family members or past relationships, the answer is usually no—we respect the wishes of the person traced. However, we will explain the situation to you clearly and may pursue follow-up enquiries with the traced individual to provide you with some answers where appropriate. We adopt a ‘case by case’ approach with this as the matters are often very delicate.

Do I need to prove my relationship to the person I’m tracing?

Do you guarantee that the person will be served?

Unfortunately, no. What we do guarantee is outstanding service, effort, and energy in the process of attempting service.

What happens if the recipient avoids service?

With substituted service, the process can still move forward. Of course, we do everything possible to serve the person directly, but deliberate avoidance can happen.

Can you apply for substituted service if the person cannot be located?

Absolutely. Our reports will provide the supporting information needed to give your lawyer the best chance of securing a substituted service order through the Court.

What happens if service cannot be completed?

This can occur from time to time, despite our best efforts. If it does, our reports and supporting commentary will provide you with the necessary information to make a decision on tracing the individual or considering an application for substituted service.

Will you keep me updated during the process?

Definitely. We know there can be significant emotional investment in these matters, so we make sure to keep you up to date.

Absolutely. That’s exactly what tracing is, and our expert team has a proven record of success in locating people for service.

Not always. If you have a phone number or email, we will attempt to engage and encourage the person to meet us for service. However, a physical address naturally provides a much better opportunity for service. If you don’t know their current address and can’t locate it, we offer a “trace and serve” process, where we first trace the individual and then organise service of the documents.

What information do I need to provide to arrange service?

A name, an address, and the documents to be served are enough for us to get started. However, we encourage you to provide as much detail as possible about the recipient (and ideally a photo), as this greatly increases the chances of locating and serving them quickly.
